You are forgetting the deal they've made with Heidfeld. The mere fact that it is a preliminary deal, doesn't mean the deal doesn't exist. According to the articles, the condition under which the deal will take of, is the condition that Jordan gets the budget they've obviously set themselves. That needs to be a specifically stated budget, otherwise it couldn't be subject to a contractual condition. You can imagine what will happen when Jordan en Heidfeld conclude a deal under the mere condition that enough budget will be raised. When the height of the budget isn't specified than it will never be clear when the condition will be fulfilled. No lawyer would accept such a clause, because it wouldn't make any sense.

So when Jordan concluded the preliminary deal with Heidfeld, it was no longer about raising as much money as possible, it was about a raising a predetermined budget which will mean (with no further interference by any of the parties) that both Jordan and Heidfeld will be bound to the obligations that are part of the deal.

So, when these 12 milion pounds fill a hole that means Jordan has the budget when the second driver will also bring financial bonusses (being it by actually paying the team, being it by existing sponsors increasing their budget and Ford lowering their demands in engineprizes), Heidfeld is definatly in at Jordan for 2004.

Both Jordan GP and Heidfeld know, because it must (as I explained) be specified in the contract.
