Exactly. There were rumblings along the pitlane at Le Mans regarding the legality of the DI engine (not just from Oreca). Clearly, any protest was not upheld (otherwise we would have heard about it?), but I'd still be interested to know which version has been used in the Le Mans Series post Le Mans.

Yes it would be nice to know. Also that has been addressed for 2010 in the ACO release from the Nürburgring

Aston Martin ran DI only at Le Mans, for Portimao onwards the ACO suggested to use the old engine without DI due to the homologation issue.
