well thats a shame, seems they are getting more and more cash straped as this year goes on, if they can't pay their mechandise makers they musn't be selling to much mechandise.

No, Legal procedings have not been started today. Despite this gentlemans statements that they have.

According to that news item it has. Set down for FEB 08 but APPAREL BY DESIGN hoping to be done by DEC 07

Evo, just because a respondant has not been served papers or been involved with the preparation of an application does not mean that legal proceedings have not commenced.

Indeed a telling aspect of the release is that they claim the matter is for mention in the High Court of New Zealand not the District Court. My recollections in this area means that the claim must be over NZ$200,000 or involve a bankruptcy factor to automatically be accepted by the High Court and or dealt with by one of the Masters of the High Court.

Dont you just love wanky legal titles.

Evo, I believe a more honest wording of your post in these times should be that "No one connected with Team Kiwi has any first hand knowledge that legal proceedings may been commenced against it in relation to any matter. Further more I can confirm that no papers have been received by TKR or it's legal advisors". Maybe given the legal title comment we can call them Statute and Common Law Advocates

What causes concern to me on these matters is the absolute nature of many of your comments in a world where absolutes are so very rare. It leaves very little room to maintain credibility if suddenly new information is brought to light.

As Mr. Intolerant rightly says - to be able to state a date something is to be heard in court more than implies 'legal proceedings have commenced' - because unless they 'have commenced' a court cannot schedule them - Catch 22 really.

One must wonder whether this struggling team is worthwhile...
What is the return on investment, if anything?
If anything, I would put the blame on TEGA and their limited grid size.
If position 32 or whatever is so valuable, why make teams struggle by hook or by crook to keep going; when as we know, grids 30+ at Bathurst during 'the good old days' were the privateer's norm.
Something's got to give.

Since there is the possiblility of something legal happening here, could we remind all posters to be very careful of what is FACT and what is implied, rumour or otherwise. If something goes to court, then we have to be very wary of what is discussed, and if it doesn't we should be wary of implying it might. Fine to link to news sources - if they're printing it then they own it and have to justify it if challenged, but for this forum if you don't know it to be true and have the evidence to prove it, then please don't post it.

This is standard procedure wherever there may be a potential of legal action, and for the course of it should it occur.

EvoMike, firstly congratulations on your good news, and I hope that this potential bad news is unsubstantiated. I do advise a dignified silence on legal matters, however, for the same reasons as we are discouraging posts from those unconnected with the matter in hand.

"An Apparel by Design spokesperson says going to court is not a step they wanted to take but after months of waiting for payment, enough is enough.

A High Court Hearing has been set down for February of next year but the company hopes it will be held as early as December."
