Does he not have a right to do the job he is contracted for?

I presume that as McLaren are paying Juan Pablo millions of $ not to race, thay have every entitlement to make him not drive. I don't suppose that their sponsers would be too happy if someone they are effectively paying is photographed possibly advertising their rivals.

It's similar to when Rossi moved from Honda to Yamaha in MotoGP. After the 2003 season ended in October, Yamaha wanted Rossi to immediately start testing the Yamaha to get a head start for the 2004 season. But as Rossi was contracted to Honda until midnight on 31/12/2003, Honda refused to allow Rossi to ride the Yamaha until his contract had expired. Thus delaying Yamaha's developement program significantly.

In F1 they normally come to an agreement where the driver tests in plain overalls or similar. It is rare nowadays for a driver to have to wait until January to test.
